Terms of Service

1. Agreement to Terms

By downloading, installing, or using the Anonymaze desktop application, online demo, or website (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service.

If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

2. Description of Service

Anonymaze provides tools to detect and replace personally identifiable information (PII) in text documents. The Service consists of:

• Desktop application: A macOS (and future platform) application that processes documents locally on your device using natural language processing (NLP) and pattern-matching algorithms.
• Online demo: A web-based service at anonymaze.ai that performs text anonymization via server-side processing.
• Website: The informational and marketing website at anonymaze.ai.

3. Eligibility

You must be at least 16 years of age to use the Service. By using the Service, you represent and warrant that you meet this age requirement and have the legal capacity to enter into a binding agreement.

4. Account Registration and Subscriptions

4.1 Free Tier

The desktop application is free for personal use with a per-file size limit of 10 MB. No account registration is required for the Free tier.

4.2 Pro and Team Tiers

Pro ($9.99/month) and Team ($29.99/month) subscriptions unlock additional features as described on the pricing page. You are responsible for maintaining the confidentiality of your account credentials.

4.3 Billing and Cancellation

• Subscriptions are billed monthly in advance via Stripe.
• You may cancel at any time. Cancellation takes effect at the end of the current billing period.
• We do not offer refunds for partial billing periods, except as required by applicable law.
• We reserve the right to change pricing with 30 days' prior notice. Existing subscribers will be grandfathered at their current price for 12 months after any price change.

5. Acceptable Use

You agree to use the Service only for lawful purposes. You may not:

• Use the Service to process documents you do not have the legal right to access or modify.
• Attempt to reverse-engineer, decompile, or disassemble any part of the Service (except where permitted by applicable law).
• Use the online demo to submit content that is illegal, abusive, threatening, or that promotes violence or discrimination.
• Circumvent rate limits, access controls, or security measures.
• Use automated scripts or bots to interact with the online demo beyond documented API endpoints.
• Redistribute, sublicense, or resell the Service without our prior written consent.
• Use the Service to facilitate identity fraud, document forgery, or evidence tampering.
• Misrepresent the Service's capabilities to third parties or claim that anonymized output is guaranteed to be free of all PII.

6. Intellectual Property

6.1 Our IP

The Anonymaze application, website, branding, documentation, and all associated intellectual property are owned by Anonymaze. You are granted a limited, non-exclusive, non-transferable, revocable license to use the Service in accordance with these Terms.

6.2 Your Content

You retain all rights to your documents and content. We do not claim any ownership or license over the content you process through the Service. This includes both the original documents and the anonymized output.

6.3 Open-Source Components

The Service incorporates open-source libraries, each subject to its own license. Use of these components is governed by their respective licenses, which are available in the application's acknowledgments section.

7. AI Accuracy Disclaimer

7.1 Limitations You Must Understand

• The Service may fail to detect some instances of PII, including but not limited to: uncommon name formats, abbreviated identifiers, contextually implied personal information, PII embedded in images (except via OCR), and handwritten text.
• The Service may incorrectly identify non-PII text as personal data (false positives), potentially altering the meaning of your document.
• Detection accuracy varies by language. Currently, English is the primary supported language. Other languages may have significantly lower detection rates.
• Detection accuracy varies by document type and format. Complex layouts, tables, headers/footers, and embedded objects may affect results.
• The Service processes text only. Metadata embedded in document files (author name, revision history, comments, GPS coordinates in images) may not be removed.

7.2 Your Responsibility

You are solely responsible for reviewing anonymized output before sharing it. The Service is a tool to assist you in identifying PII — it is not a substitute for human review, legal counsel, or compliance auditing. If you are processing documents subject to regulatory requirements (GDPR, HIPAA, CCPA, etc.), you must implement additional controls as required by applicable law.

8. Desktop vs. Online — Important Differences

We strongly recommend the desktop application for any document containing sensitive, confidential, or regulated data.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:

• WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT;
• ANY WARRANTY THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE;
• ANY WARRANTY REGARDING THE ACCURACY, COMPLETENESS, OR RELIABILITY OF PII DETECTION;
• ANY WARRANTY THAT THE SERVICE WILL DETECT ALL INSTANCES OF PERSONAL DATA IN YOUR DOCUMENTS;
• ANY WARRANTY THAT ANONYMIZED OUTPUT WILL COMPLY WITH ANY SPECIFIC LAW, REGULATION, OR STANDARD.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:

1. No consequential damages: IN NO EVENT SHALL ANONYMAZE, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, BUSINESS OPPORTUNITIES, GOODWILL, OR REPUTATION, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE.
2. Liability cap: OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING FROM OR RELATED TO THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100).
3. Specific exclusions: WITHOUT LIMITING THE FOREGOING, WE SHALL NOT BE LIABLE FOR ANY DAMAGE OR LOSS RESULTING FROM:
   • Failure of the Service to detect any specific instance of PII;
   • Unauthorized disclosure of personal data that the Service failed to anonymize;
   • Regulatory fines, penalties, or enforcement actions related to inadequate anonymization;
   • Any action taken based on reliance on the Service's output without independent verification;
   • Data loss, corruption, or modification resulting from use of the Service.

Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability. In such jurisdictions, our liability shall be limited to the fullest extent permitted by applicable law.

11. Indemnification

You agree to indemnify, defend, and hold harmless Anonymaze and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorney's fees) arising out of or in any way connected with:

• Your use of the Service;
• Your violation of these Terms;
• Your violation of any third-party rights, including privacy rights;
• Your processing of documents that you did not have the legal right to process;
• Any claims by third parties resulting from personal data that the Service failed to detect or adequately anonymize in documents you processed.

12. Modifications to the Service

We reserve the right to modify, suspend, or discontinue any part of the Service at any time, with or without notice. We will make reasonable efforts to provide advance notice of material changes, particularly those affecting paid subscriptions. We are not liable for any modification, suspension, or discontinuation of the Service.

13. Termination

13.1 By You

You may stop using the Service at any time. To delete your account (if applicable), email support@anonymaze.ai. Uninstalling the desktop application removes all local application data.

13.2 By Us

We may suspend or terminate your access to the Service if:

• You violate these Terms;
• We are required to do so by law;
• We reasonably believe your use poses a risk to the Service, other users, or third parties.

We will provide notice of termination where feasible, except in cases of serious violations or legal requirements. Upon termination, your license to use the Service is revoked. Sections 6, 7, 9, 10, 11, and 15 survive termination.

14. Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated via email (for registered users) and/or a prominent notice on the website at least 30 days before they take effect. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms. If you do not agree with the changes, you must stop using the Service.

15. Governing Law and Dispute Resolution

15.1 Governing Law

These Terms are governed by and construed in accordance with the laws of the European Union and the jurisdiction in which Anonymaze is established, without regard to conflict of law principles.

15.2 Dispute Resolution

Any dispute arising from or relating to these Terms or the Service shall be resolved as follows:

1. Informal resolution: You agree to first contact us at legal@anonymaze.ai to attempt to resolve the dispute informally. We will endeavor to respond within 14 business days.
2. Mediation: If informal resolution fails within 30 days, either party may propose non-binding mediation.
3. Jurisdiction: If mediation fails or is declined, disputes shall be submitted to the competent courts of the jurisdiction in which Anonymaze is established.

15.3 Class Action Waiver

To the extent permitted by applicable law, you agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action.

16. General Provisions

• Entire agreement: These Terms, together with the Privacy Policy, constitute the entire agreement between you and Anonymaze regarding the Service.
• Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions remain in full force and effect.
• Waiver: Our failure to enforce any right or provision of these Terms does not constitute a waiver of that right or provision.
• Assignment: You may not assign your rights under these Terms without our prior written consent. We may assign our rights without restriction.
• Force majeure: We are not liable for any failure or delay in performance due to circumstances beyond our reasonable control.
